Terms of Service

1. Scope & Acceptance

These Terms of Service ("Terms") govern your use of the Frascati platform (frascati.app), operated by Fabiano Frascati, Frascati Systems (Einzelunternehmen), Switzerland. By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use the platform.

2. Description of Service

Frascati is an AI-powered website builder that allows users to create web applications through natural language prompts. The Service includes: AI-assisted code generation, a live preview editor, project management, publishing to frascati.app/p/[slug], code export, and related features as described on our pricing page.

3. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use. You must be at least 16 years old to use the Service. One person may not maintain more than one free account.

4. Subscription Plans & Billing

Frascati offers free and paid subscription plans. Paid plans are billed monthly in Swiss Francs (CHF) via Stripe. Subscriptions automatically renew at the end of each billing period. You may cancel at any time through your account settings or the Stripe Customer Portal — access continues until the end of the current billing period. Credit top-ups are one-time purchases and are non-refundable. We reserve the right to change pricing with 30 days prior notice. Price changes do not affect the current billing period.

5. Credits & Usage Limits

Each plan includes a monthly credit allowance. Credits are consumed when using AI features (code generation). Unused monthly credits do not roll over to the next period. Bonus credits (from purchases or referrals) do not expire and are consumed only after monthly credits are exhausted. Project limits, publishing limits, and feature access vary by plan as described on our pricing page.

6. AI-Generated Content

Code and content generated by AI models is provided "as is" without any warranty. Frascati does not guarantee that AI-generated code is: free of errors or bugs, secure or free of vulnerabilities, free of intellectual property issues, suitable for any particular purpose, or complete or production-ready. You are solely responsible for reviewing, testing, and validating all generated code before use or deployment. AI outputs may occasionally contain inaccuracies, inappropriate content, or code that does not function as intended.

7. Intellectual Property

Your content: You retain full ownership of all content you create, including prompts, uploaded files, and project configurations. AI-generated code: Under Swiss copyright law (URG Art. 2), purely AI-generated works may not qualify for copyright protection. Regardless, you receive an unrestricted, perpetual license to use, modify, distribute, and commercialize all code generated through your use of Frascati. Platform IP: Frascati retains all rights to the platform, its technology, branding, design, and documentation. Published projects: By publishing a project, you grant Frascati a non-exclusive license to host and serve the content at the assigned URL.

8. Acceptable Use

You agree not to use Frascati to: generate illegal, harmful, or malicious content (malware, phishing pages, etc.); infringe on third-party intellectual property rights; create content that is discriminatory, harassing, or violates the rights of others; attempt to reverse-engineer, exploit, or disrupt the Service; circumvent usage limits, rate limits, or security measures; use automated tools or scrapers without prior written consent; resell access to the Service or share account credentials. We reserve the right to remove content and suspend accounts that violate these terms.

9. Published Projects

Projects published at frascati.app/p/[slug] are publicly accessible. You are solely responsible for the content of your published projects. Published projects may display a "Built with Frascati" badge (removable on Pro and Business plans). We reserve the right to unpublish projects that violate these Terms or applicable law. Frascati is not responsible for third-party use of your published content.

10. Data & Privacy

Our collection and use of personal data is described in our Privacy Policy (frascati.app/privacy). By using the Service, you acknowledge that your prompts are processed by third-party AI providers (see Privacy Policy Section 4-5). You agree not to submit sensitive personal data (health data, financial account numbers, government IDs) in AI prompts.

11. Service Availability

We aim for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime caused by third-party services (AI providers, hosting, payment processors, etc.). Current service status is available at frascati.app/status.

12. Limitation of Liability

To the maximum extent permitted by Swiss law (Art. 100 OR): Frascati is provided "as is" without warranties of any kind, express or implied. We are not liable for indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business opportunities. Our total aggregate liability is limited to the amount you paid for the Service in the 12 months preceding the claim. These limitations do not apply to liability for intentional or grossly negligent conduct, which cannot be excluded under Swiss law.

13. Indemnification

You agree to indemnify and hold harmless Frascati and its operator from any claims, damages, or expenses arising from: your use of the Service, content you create or publish, your violation of these Terms, or your violation of any third-party rights.

14. Termination

You may delete your account at any time through account settings. We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible. Upon termination: active subscriptions are cancelled (no refund for the remaining period), you may export your projects within 30 days, after 30 days all data is permanently deleted. We may retain billing records as required by law (see Privacy Policy Section 7).

15. Changes to Terms

We may update these Terms to reflect changes in our Service or legal requirements. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes take effect constitutes acceptance. If you disagree with updated Terms, you may terminate your account before the changes take effect.

16. Governing Law & Jurisdiction

These Terms are governed by Swiss law (Schweizerisches Recht), excluding conflict-of-law rules. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at the domicile of the operator in Switzerland. For consumers in the EU/EEA, mandatory consumer protection laws of your country of residence may apply in addition to these Terms.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
